Resolution 2012-029: Ordinance 2012-003 Transient Merchant, Solicitors, Peddlers Ordinance
Resolution 2012-030: Ordinance 2012-004 City Code Appendix I, Fee Schedule
Holthaus reviewed the process for approving a solicitor permit and the type of door-to-door activity that will require a permit. Holthaus also noted that the proposed ordinance included exclusion by placard provisions which would afford property owners the ability to prohibit door-to-door solicitors by placing a sign of a certain size on their property noting that solicitation is prohibited.
Hennen moved and K. Goebel seconded a motion on Resolution 2012-029: Ordinance 2012-003 Transient Merchant, Solicitors, Peddlers Ordinance and Resolution 2012-030: Ordinance 2012-004 City Code Appendix I, Fee Schedule. Discussion offered. A roll call vote was taken: Worms – Aye; Hennen – Aye; K. Goebel – Aye; Ritter – Aye; and C. Goebel – Aye. Motion carried 5-0.
Storm Damage
Holthaus noted that a claim had been filed with LMC for property damage from the storm on May 1, 2012.
Lease Agreement: Industrial Park Land
Holthaus updated Council on discussion with the county assessor’s office and private parties related to farming of the industrial park land. Holthaus noted that two tenants came forward who are eligible for agricultural homestead tax classification. Because property tax will be assessed by the county upon the tenant farming the land, an agricultural homestead classification is necessary to reduce the cost of farming the land to comparable market rates. For the first year the tenant would pay the City $220 per acre and in subsequent years the tenant would pay the property taxes due as rent.
Holthaus will ask Attorney Scott Hamak to prepare an agricultural lease agreement. Council stated the agreement should not restrict the type of crop planted, however no crop loss shall be paid in the event land is sold for development.
K. Goebel moved and Hennen seconded a motion authorizing Worms and Holthaus to negotiate the final terms of the Farm Lease with Middendorf Family Farms, LLC and Chris Middendorf and to execute the final agreement. Discussion offered. Motion carried 5-0.
